1. Agreement

These Terms of Service (“Terms”) govern your use of the BlackFort Wallet applications for iOS, Android and Chrome (the “App”) and the website blackfortwallet.com, provided by BLACKFORT PLATFORMS LLC, registered in St. Vincent and the Grenadines, Griffith Corporate Centre, Beachmont, Kingstown, St. Vincent and the Grenadines (“BlackFort”, “we”, “us”). By installing or using the App you agree to these Terms. If you do not agree, do not use the App.

2. Non-custodial software

The App is self-custody software. You alone generate, hold and control your seed phrase and private keys. BlackFort never has access to your keys or funds, cannot execute or reverse transactions on your behalf, and cannot recover a lost seed phrase. You are solely responsible for backing up your seed phrase and for all activity conducted with your wallet.

3. Eligibility

You must be at least 18 years old and legally able to enter into these Terms. You may not use the App if you are located in, or a resident of, a jurisdiction where the App or digital-asset activity is prohibited, or if you are subject to sanctions.

4. Licence

We grant you a limited, revocable, non-exclusive, non-transferable licence to use the App for your personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, reverse-engineer, distribute or create derivative works of the App except where open-source components are licensed otherwise.

5. Third-party services and networks

The App lets you interact with public blockchain networks and with independent third-party services (for example asset purchase, swap, staking, node or price providers). Those services are provided by third parties under their own terms; BlackFort is not a party to those transactions and is not responsible for their availability, fees, execution or outcomes. Network fees are set by the relevant blockchain, not by BlackFort.

6. Risks

Digital assets are volatile and transactions on blockchains are irreversible. You accept all risks of using the App, including loss of assets through market movements, user error, sending to an incorrect address, phishing, malware, network failures, protocol changes or forks. Nothing in the App is financial, investment, legal or tax advice.

7. Acceptable use

You agree not to use the App for any unlawful purpose, including money laundering, terrorist financing, sanctions evasion or fraud; not to interfere with the App or its infrastructure; and not to attempt to gain unauthorised access to any system or other user’s wallet.

8. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation, to the fullest extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, BlackFort and its affiliates, officers and employees shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of digital assets, profits, data or goodwill, arising from your use of or inability to use the App. Our total aggregate liability for any claim shall not exceed USD 100.

10. Indemnity

You agree to indemnify and hold BlackFort harmless from any claims, losses and expenses arising from your breach of these Terms or your use of the App.

11. Changes and termination

We may update these Terms or modify or discontinue the App at any time. Updated Terms take effect when posted here. Because the App is non-custodial, discontinuation of the App does not affect your ability to access your assets with your seed phrase in other compatible software.

12. Governing law and disputes

These Terms are governed by the laws of St. Vincent and the Grenadines. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of St. Vincent and the Grenadines, without prejudice to any mandatory consumer rights you may have in your country of residence.
